Let Us Pray: Major Win for Free Speech in Louisville

In 2021, the Louisville Metro Council voted 14-11 to enshrine a 10-foot “buffer zone” around the entrance of the city’s primary abortion mill. This action was taken to stop pro-life advocates from regularly gathering outside the facility to pray, offer mothers-in-crisis alternative options, and minister the best they can.

The measure was challenged in court as it was argued it violated religious liberty rights and freedom of speech. The legal fight lasted for three long and straining years as there were setbacks and difficulties throughout the legal war.

Thankfully, on Friday, District Judge Rebecca Grady Jennings granted a motion for summary judgment which provides a permanent injunction on the buffer zone ordinance that was passed in 2021 by the Metro Council. The ruling shows that the ordinance violated the First Amendment rights of pro-life advocates who peacefully counseled many hurt and vulnerable women as they were entering the EMW Abortion Facility in Louisville—a clinic that has since been shut down.

The case was initially brought by our friends at Kentucky Right to Life and Sisters for Life. Kentucky Right to Life Executive Director Addia Wuchner said in response to the ruling, “This decision is not just a victory for those who stand for life on the sidewalks, offering compassion, resources, and alternatives to abortion—it is a profound First Amendment victory for all who believe in the fundamental right to free speech.”

Make no mistake about it, this ruling is a major win for the pro-life movement and for our First Amendment rights.

Lord, we thank You for those who worked so diligently through the ups and downs of this legal battle until this permanent injunction was put into place.
