The Family Foundation Opposes the ACLU’s Meritless Abortion Lawsuit and Will Continue to Defend the Right to Life in Kentucky!
This week, 2 of our team members, Jesse Green and Nick Spencer, joined Kentucky Right to Life and pro-life champion Rep. Nancy Tate at the preliminary hearing on the ACLU’s pro-abortion lawsuit. The court delayed ruling on whether the plaintiff could accurately represent a class of all women who are or may become pregnant until parties could collect evidence on that question. Jefferson Circuit Judge Tracy E. Davis scheduled a hearing on that manner for January 3, 2025.
Lindsey Keiser represented the Attorney General’s Office in defending Kentucky’s pro-life laws. She argued that the issue of abortion is a political question that should be settled by the legislative process, not the judiciary. We strongly agree with that position and commend Ms. Keiser for her commitment to defending Kentucky’s pro-life laws.
Tragically, the ACLU announced after the hearing that Baby Poe, the child of the mother, “Mary Poe,” who brought the legal challenge, was murdered by abortionists across state lines, where killing a preborn child is still “legal.” According to court documents, Poe will remain a plaintiff in this case because she “satisfied Kentucky’s constitutional standing requirements at the time of filing, when she was pregnant and seeking abortion care.” The ACLU contends “this action continues to present a justiciable cause and should proceed.” Not surprisingly, the ACLU’s legal filing did not acknowledge the humanity of Baby Poe, instead only callously stating that Mary Poe “is no longer pregnant” after traveling to another state to obtain an abortion.
We will continue to work tirelessly in Baby Poe’s memory to further protect Kentucky’s preborn children, and we will not rest until every child has a chance to live the life God has planned for them.
Please continue to pray for the Attorney General’s team who are defending KY’s pro-life laws, the judge who will decide the fate of KY’s pro-life laws, and for everyone working to ensure that Kentucky has strong protections for the preborn children of our Commonwealth.
