Appalling Act of Raw Judicial Activism Allows Abortion Industry to Resume Killing Unborn Children in Kentucky

LEXINGTON, KY – In an appalling act of judicial activism, Jefferson County Circuit Court Judge Mitch Perry has allowed Kentucky’s abortion mills to temporarily resume profiting off “the termination of the life of an unborn human being.” The judge issued a temporary restraining order to halt Kentucky’s Human Life Protection Act that had gone into effect after the U.S. Supreme Court overturned Roe last Friday. The Human Life Protection Act, also known as the conditional “trigger” abortion ban, prohibits abortions in the Commonwealth unless the procedure is necessary to protect the life of the mother.

“Judge Perry’s appalling action to temporarily block Kentucky’s Human Life Protection Act is egregiously wrong and unjustifiable. Perry has blatantly disregarded the Commonwealth’s pro-life history, laws, the will of the people, and the U.S. Supreme Court. Make no mistake, this action by one judge in Kentucky will directly result in Kentucky’s abortion industry resuming killing children in the womb.”

“This is a crystal-clear reminder why Kentuckians must ensure that this injustice is only temporary and this state-level judicial activism can never happen again by passing the “Yes for Life” Constitutional Amendment on November 8,” Walls concluded.

The Commonwealth’s abortion mills had been closed since Friday, June 24, when the U.S. Supreme Court declared that there is no federal right to abortion, activating Kentucky’s Human Life Protection Act and prohibiting “the termination of the life of an unborn human being.”

Yesterday, in the court room, Attorney General Daniel Cameron’s office made clear that the status quo in Kentucky is an ongoing 150-year pro-life legacy of protecting the life of an unborn human being to the greatest extent allowed by the U.S. Constitution. More importantly, the court and the public were reminded that there were over 200 preborn children alive at that moment because the abortion mills had closed Friday.
