As mentioned above, the ACLU recently filed a class action lawsuit against Kentucky’s pro-life laws on behalf of Mary Poe, a resident of Jefferson County who chose to be identified under a pseudonym. Poe is seeking to overturn Kentucky’s abortion restrictions, claiming the Kentucky Constitution contains a hidden right to kill a preborn child that should overturn Kentucky’s duly-enacted pro-life laws. She is also claiming to represent a class of persons, which includes all current or future pregnant women living in the Commonwealth.
The Family Foundation and pro-life allies attended an initial hearing held in Jefferson County Circuit Court on November 18th where Judge Tracy Davis heard motions from the ACLU related to certifying the class that Poe claims to represent. Upon pushback from the Attorney General’s office, the judge delayed ruling on class certification until at least early-January of 2025. This delay keeps Kentucky’s current pro-life laws in place pending further preceedings. Despite the delays in the case, the ACLU broke the dreadful news that Mary Poe had traveled out-of-state to kill her unborn child, Baby Poe, just a few days after filing the lawsuit.
The Family Foundation will continue to follow the important updates in this case along with our ally, Kentucky Right to Life. In the meantime, we encourage our supporters to be in prayer for the Attorney General’s office that they would strongly defend Kentucky’s laws, that the judge would rule in this case righteously, and that Mary Poe would be convicted of her sin, turn to Christ, and drop her lawsuit.
