LEXINGTON, KY — On Thursday, April 22, 2021, The Family Foundation once again moved to transfer the 10-year old slot-gaming case to the Kentucky Supreme Court.
HISTORY: On Sept. 24, 2020, the Supreme Court unanimously reversed the Franklin Circuit Court and found illegal the slot-gaming facilitated by the Kentucky Horse Racing Commission and operated by the racetracks. The High Court unanimously directed the Franklin Circuit Court to enter a judgment consistent with the unanimous Opinion reversing. The Franklin Circuit Court refused. Instead, the Franklin Circuit Court invited the race tracks to provide input in the judgment. When the Judgment was entered by the Franklin Circuit Court on March 17, 2021, the Franklin Circuit Court’s Judgment nullified the earlier Supreme Court’s Opinion reversing. The Family Foundation appealed. Because of the Franklin Circuit Court’s affront to the Kentucky Supreme Court, The Family Foundation seeks again to have the Kentucky Supreme Court adjudge the case. If the Supreme Court accepts transfer of the appeal, this will be the third time the slot-gaming case will be before the State’s Highest Court.
